1. Purpose
MC Studio is a trade name of REVE Media, KVK 88874990, VAT identification number NL004665647B65, with its business address at Diamantdreef 16, 7828 AW Emmen, the Netherlands.
MC Studio may store files, images, text and other information at a user's request. Where this makes MC Studio a hosting/intermediary service under the EU Digital Services Act (DSA), this Policy explains how alleged illegal content can be reported and how MC Studio handles content restrictions.
2. How to report alleged illegal content
Use the dedicated electronic illegal-content notice form in MC Studio's Legal/Contact area. If the form is temporarily unavailable, contact legal@mcstudio.io with subject Illegal Content Notice.
A notice should include:

a sufficiently substantiated explanation of why the information is alleged to be illegal;

the exact electronic location or other precise identifier that enables MC Studio to locate the information;

the notifier's name and email address, except where the DSA permits a notice without those identity details for the relevant category of alleged offence; and
-
a statement confirming the notifier's good-faith belief that the information and allegations are accurate and complete.
Do not send passwords, private keys or unnecessary sensitive personal data.
3. Receipt and assessment
If electronic contact details are provided, MC Studio sends an acknowledgement of receipt without undue delay.
MC Studio assesses notices in a timely, diligent, objective and non-arbitrary manner. A notice that is sufficiently precise and substantiated may create legal knowledge/awareness of the specific content for DSA purposes.
The existence of a notice does not automatically mean the reported information is illegal.
4. Decision and notifier information
Where the notifier supplied electronic contact details, MC Studio informs the notifier without undue delay of the decision concerning the reported information and the available possibilities for redress.
MC Studio may request clarifying information if a notice does not identify the content or legal issue sufficiently.
5. Restrictions on user content or accounts
MC Studio may remove information, disable access, restrict visibility, restrict payments, suspend part of the Service or suspend/terminate an account where:

the information is illegal;

the information materially violates the Terms or applicable product rules;

action is required by a competent authority;
-
urgent action is reasonably required for security, safety or prevention of serious harm; or
-
another contractual/legal ground permits the restriction.
Restrictions are intended to be targeted and proportionate.
6. Statement of reasons
Where Article 17 DSA applies and MC Studio knows the affected user's electronic contact details, MC Studio provides a clear and specific statement of reasons for a restriction based on allegedly illegal content or incompatibility with the Terms.
The statement may include, as applicable:

the type and scope of restriction;

the relevant facts/circumstances;
-
whether a notice or MC Studio's own investigation led to the decision;
-
whether automated means materially contributed to the decision;
-
the legal or contractual ground relied on; and
-
available redress options.
Information may be withheld where the DSA or another law permits or requires this, including where disclosure would undermine a criminal investigation or create a serious security risk.
7. User challenges and redress
An affected user may challenge an MC Studio content-restriction decision by replying to the decision notice or contacting legal@mcstudio.io with enough information to identify the decision.
This does not limit access to any out-of-court or judicial remedy available under mandatory law.
8. Cooperation with authorities
MC Studio responds to valid orders and information requests from competent authorities as required by applicable law, including the DSA and applicable e-evidence rules.
9. Repeated abuse of the notice mechanism
MC Studio may take proportionate measures against manifestly abusive or fraudulent notices, while preserving legitimate access to the statutory notice mechanism.
