1. Three different concepts
For clarity, MC Studio distinguishes:
-
Normal cancellation - stops a future subscription renewal. It does not normally refund a correctly supplied current paid period.
-
Statutory withdrawal - a Consumer's legal cooling-off right for certain distance contracts.
-
Remedies for a defective or non-conforming Service - separate rights that may apply if MC Studio fails to provide what was contractually promised.
Nothing in this policy limits mandatory consumer rights.
2. Consumers - statutory cooling-off period
Where the statutory right of withdrawal applies, a Consumer may withdraw from an online service contract without giving a reason within 14 days after the contract is concluded. For a service contract, this period begins on the day after conclusion of the contract.
MC Studio will provide required information about the right of withdrawal before purchase and will provide a durable confirmation after purchase.
If legally required withdrawal information is not provided correctly, the withdrawal period is extended as provided by applicable law. You meet the deadline by sending your withdrawal statement before the applicable period expires.
3. How a Consumer may withdraw
A Consumer may exercise the right of withdrawal by any clear statement permitted by applicable law, including:

using the statutory online withdrawal function provided by MC Studio during the applicable withdrawal period;

emailing billing@mcstudio.io, legal@mcstudio.io or info@mcstudio.io;
-
using the model withdrawal form at the end of this policy; or
-
another clear communication that identifies the contract and the Consumer's decision to withdraw.
No reason is required.
Where the online withdrawal function is used, MC Studio will provide an electronic confirmation on a durable medium identifying the contract and the date and time of the withdrawal request.
4. Online withdrawal function
For a Consumer distance contract concluded through an online interface where a statutory withdrawal right applies, MC Studio provides a clearly visible, easily accessible withdrawal function throughout the applicable withdrawal period. Its availability and location are identified before purchase.

Provide or confirm your name, the contract or order you wish to withdraw from, and the electronic contact details for receiving confirmation.

Submit your statement using Confirm withdrawal, or the equivalent confirmation control.

MC Studio sends an acknowledgement on a durable medium, such as email, without undue delay. The acknowledgement records the content of your statement and its submission date and time.
The function is an additional route. It does not replace the optional model form or another clear withdrawal statement. Withdrawal is not subject to MC Studio's discretionary approval.
5. Refund timing after a valid withdrawal
Where a refund is due following a valid withdrawal, MC Studio will refund the amount required by law without undue delay and no later than the applicable statutory deadline, normally within 14 days after receiving the withdrawal notice.
Refunds are normally made using the same payment method used for the original transaction unless the Consumer expressly agrees otherwise and no additional cost is imposed.
6. Starting a service during the cooling-off period
A Consumer may ask MC Studio to begin providing a paid service before the 14-day cooling-off period ends.
Where applicable law permits, if the Consumer later withdraws before the service has been fully performed, MC Studio may charge only the proportionate amount lawfully due for the part of the service already provided, provided the legally required information and express request were obtained before performance began.
For a time-limited service, MC Studio will use a fair calculation reflecting the service actually supplied, subject to mandatory law.
7. Production Pass - what is being purchased
The Production Pass is sold as:
EUR 9.90 incl. VAT · one eligible project · 168 consecutive hours of CAD/CAM Plus-level production/export access.
The customer is not purchasing one export click. During an active Pass, the customer may, within the supported scope:
-
generate the initial eligible production/cutting-list output;
-
inspect it;
-
continue editing the same project;
-
regenerate the output; and
-
re-export updated versions during the 168-hour period.
The Pass starts when successful payment is confirmed and the 168-hour clock does not pause while the user is offline. The Pass remains associated with the purchasing workshop/workspace but is bound to the exact project ID selected at checkout/activation. Duplicating or copying that project creates a new project ID and does not transfer the Pass.
8. Consumer Production Pass - immediate-performance request
To activate a Consumer Production Pass immediately during the cooling-off period, MC Studio asks you to make two separate confirmations. Neither is selected in advance:
Start my Production Pass immediately. I expressly request MC Studio to begin providing the 7-day Production Pass now, before my 14-day statutory withdrawal period has ended.
I understand what this means for my withdrawal right. My right of withdrawal ends once the 168-hour Production Pass has been fully provided. If I withdraw before then, MC Studio may charge a proportionate amount for the part of the service already provided, where permitted by applicable law.
MC Studio will retain evidence of the relevant consent and entitlement, including the account/user identifier, Pass/entitlement identifier, parent workshop/workspace identifier, exact project ID, Stripe transaction/payment identifier, successful-purchase timestamp, Pass start and expiry timestamps, entitlement status, version of the wording accepted, Terms/policy version and each acceptance timestamp.
9. When the Production Pass is fully performed
For withdrawal purposes, the Production Pass is fully performed when MC Studio has fully provided the agreed 168-hour service window, including an agreed extension forming part of that same Service where applicable. Loss of the withdrawal right through full performance requires the legally required express request for immediate performance and acknowledgement concerning the withdrawal right. Mere expiry of the scheduled time does not remove remedies for a Service that was not properly supplied.
Using the export function during the active Pass is evidence that the Service has actually been used. However, the first export does not by itself convert the 168-hour service into a one-export purchase and does not by itself eliminate a Consumer's statutory withdrawal right.
If a Consumer validly withdraws before full performance, any reduction from the refund will be limited to the proportionate amount MC Studio is lawfully entitled to retain.
10. Production Pass practical guidance
We recommend purchasing your Production Pass when your initial design is ready. Your 168-hour access period starts when successful payment is confirmed. During that period, you can make adjustments to the same project and regenerate and re-export eligible production outputs as often as needed.
This recommendation helps you use the full seven-day period for final adjustments and re-exports. It does not limit your statutory rights or MC Studio's responsibility for a defective or non-conforming Service.
11. Business Customer Production Passes
The statutory consumer cooling-off right does not apply to a genuine Business Customer purchase.
For a Business Customer, an activated Production Pass is normally non-refundable, except where:

the Order expressly provides otherwise;
-
MC Studio materially fails to provide the purchased Service;
-
an MC Studio outage materially prevents use and MC Studio does not provide an appropriate restoration of access; or
-
applicable law requires a remedy.
12. Monthly subscriptions
Voluntarily cancelling a monthly subscription normally:
-
stops the next renewal; and
-
leaves paid access active until the end of the current paid period.
It does not normally create a pro-rata refund merely because the customer chooses to stop using the Service early.
Consumer statutory rights remain unaffected.
13. Annual Business subscriptions
An annual Business subscription is a fixed 12-month commitment unless the Order says otherwise.
Voluntary non-use or early cancellation by the Business Customer does not create a pro-rata refund merely because some months remain unused.
This does not limit remedies if MC Studio materially breaches the agreement or if applicable law requires a remedy.
14. Annual Consumer subscriptions
Annual Consumer subscriptions remain subject to all mandatory withdrawal, conformity, termination and renewal rights. Where Dutch rules on automatic renewal apply, the renewed period must remain cancellable with no more than the mandatory notice period and unused prepaid value must be repaid where the law requires it.
A cancellation of future renewal is separate from a statutory withdrawal request.
15. Defective or non-conforming Services
The end of a cooling-off period does not remove rights that may apply because a digital service is defective or does not conform to the contract.
Depending on applicable law and circumstances, remedies may include:

restoring access;
-
bringing the Service into conformity;
-
extending or reissuing an entitlement;
-
a proportionate price reduction;
-
termination; or
-
a refund.
16. Production Pass outages
If a verified outage attributable to MC Studio materially prevents use of an active Production Pass, MC Studio will normally restore the materially lost access by extending the Pass expiry time. If extension is not technically practical, MC Studio may provide an equivalent replacement entitlement.
A short interruption does not automatically create a cash-refund entitlement. Mandatory legal remedies remain unaffected.
17. Refunds caused by MC Studio ending a prepaid Service
If MC Studio ends a prepaid Service before the paid term ends without customer fault, MC Studio will provide an appropriate continuation option, replacement or refund of the unused prepaid portion where required by law or appropriate under the Terms.
18. Chargebacks and payment disputes
Please contact MC Studio before initiating a chargeback where reasonably possible so that the issue can be investigated.
A chargeback or reversed payment does not create a right to retain an unpaid entitlement. MC Studio may revoke unpaid paid functionality where legally permitted.
Fraudulent or deliberately abusive chargebacks may be treated as a serious breach of the Terms.
19. Model withdrawal form
Use of this form is optional. A Consumer may use another clear statement where permitted by law.
