These Terms of Service ("Terms") govern access to and use of MC Studio's websites, applications, CRM, CAD/CAM tools, workspaces, subscriptions, Production Passes and related services (together, the "Services").
MC Studio is a trade name of REVE Media, registered in the Dutch Trade Register under KVK number 88874990, VAT identification number NL004665647B65, with business address Diamantdreef 16, 7828 AW Emmen, the Netherlands.

These Terms apply when they are presented or made available to you before account creation, checkout, an Order or another contracting step and you accept them. The material plan, price, duration, renewal and consumer information shown directly in the applicable Order or checkout forms part of the agreement and is not replaced by general wording in these Terms. If you act on behalf of a business or organisation, you confirm that you are authorised to bind it.
1. Definitions
Business Customer means a customer acting for purposes relating to a trade, business, craft or profession.
Consumer means an individual acting wholly or mainly outside a trade, business, craft or profession.
Customer Content means data, designs, files, photographs, CRM records, project information, text, measurements, templates and other content submitted to or created in the Services by or for a customer, excluding MC Studio Materials.
MC Studio Materials means the Services, software, source code, interfaces, documentation, trademarks, MC Studio-created libraries, templates, verification records and other materials owned or licensed by MC Studio.
Order means the checkout page, order confirmation, written offer or other commercial document identifying the purchased Service, price, billing period and any customer-specific terms.
Production Pass means the one-project, 168-hour CAD/CAM Plus-level production/export entitlement described in these Terms and the applicable checkout.
Verified Asset means an MC Studio-provided library item, machining definition, hardware definition or other technical asset that MC Studio has explicitly marked "Verified" and linked to a published verification record or supported conditions.
2. Who may use MC Studio
You must provide accurate account information and keep your login credentials secure.
People under 18 may use paid Services only with permission from a parent or legal guardian or where they otherwise have legal capacity under applicable law. If a user is under 16 and MC Studio relies on consent as the legal basis for processing that user's personal data, parental or guardian authorisation is required.
Free Services may be used for learning, exploration and design subject to these Terms. A parent or guardian should supervise younger users where appropriate.
3. Consumer and Business Customer status
Customer status is determined by the purpose for which the Service is purchased, not merely by the plan name or a website toggle.
A Consumer who purchases a plan normally intended for professionals retains mandatory consumer rights. A Business Customer does not receive consumer-only rights merely because a consumer-facing checkout was used.
MC Studio may request reasonable business information, such as a company name, VAT number or KVK/company registration number, to support B2B invoicing and tax treatment.
4. The Services and feature status
MC Studio is browser-based furniture-design and workshop software combining business/workspace functionality with furniture-design and, where separately released, production-related capabilities.
Features may be labelled:

Supported / Generally Available - part of the current supported Service for its documented purpose.
-
Beta / Early Access - available for use but still being refined and subject to documented limitations.
-
Experimental - test functionality that may change materially or be withdrawn and should not be relied on for production-critical work unless expressly stated.
-
Development / Not Available - roadmap or development functionality that is not part of the customer's contractual entitlement.
The product description, plan page, Order and release documentation current at the time of purchase determine the purchased scope. Roadmap statements, demonstrations, screenshots, prototypes and discussions about future functionality do not create a contractual commitment unless expressly included in an Order.
Information about available features, supported uses, known limitations and release status is provided on our product pages and in our release documentation, including dated product updates. Features described as planned, in development or on the backlog are not currently included unless expressly agreed in your Order. Availability may depend on your plan. Production Pass provisions apply when that Pass is offered for an eligible export capability identified at checkout.
A later product update or blog post does not, by itself, change the scope already purchased or replace any direct notice required under these Terms or applicable law.
MC Studio will not retroactively relabel a feature that was represented as Supported merely to avoid responsibility for an issue that occurred while it was Supported.
For Consumers, MC Studio will provide updates, including security updates, that are required to keep the digital Service in conformity for the period required by applicable consumer law. A Consumer should install supplied updates within a reasonable time where installation is under the Consumer's control and MC Studio has explained the consequences of not doing so.
5. Plans, seats and entitlements
MC Studio uses Free, Plus and Professional capability levels across CRM and CAD/CAM where those product areas are offered.
Plan limits and included seats are described on the current pricing page and in the Order. Named-user seats are for individual users and may not be shared as a substitute for purchasing the number of active users required.
Legitimate seat reassignment for staffing changes is permitted subject to reasonable anti-abuse controls.
A full CAD/CAM Professional seat includes that named user's CRM Professional access where the applicable plan says so.
Normal recurring subscription entitlements are administered at the workspace/workshop level. A Production Pass is different: it remains associated with its parent workshop/workspace but is additionally bound to one exact project ID.
A paid entitlement controls the ability to use paid functionality. Expiry, downgrade or cancellation does not remotely invalidate files that were lawfully exported while the relevant entitlement was active.
6. Production Pass
When MC Studio offers the Production Pass, the standard price is EUR 9.90 including VAT for consumer purchases unless a different lawful price is shown at checkout.
A Production Pass:
-
belongs to the purchasing workshop/workspace context and is additionally bound to one specific project ID;
-
starts when successful payment is confirmed by the billing backend;
-
runs for exactly 168 consecutive hours;
-
allows eligible CAD/CAM Plus-level production exports for that same project during the active period, including revisions, regeneration and re-exports;
-
does not pause while the user is offline;
-
is non-transferable and cannot be banked for later use;
-
does not transfer to a duplicated or copied project;
-
does not unlock other projects in the same workshop/workspace; and
-
does not unlock Professional CNC, G-code, post-processor, professional automation or other Professional-only functionality unless expressly stated in the applicable supported product description.
A copied or duplicated project receives a new project ID and does not inherit the original Production Pass. A separate Pass or another valid entitlement is required for that new project.
Users are encouraged to activate the Pass when their initial design is substantially ready so that the full seven-day window remains available for final checks, edits and re-exports.
For Consumers, statutory withdrawal rights and the special immediate-performance consent flow are governed by the Refund & Withdrawal Policy. A first export is evidence that the Service has been used, but the Production Pass is treated as a 168-hour service window rather than a single-export purchase.
If a verified MC Studio outage materially prevents use of an active Production Pass, MC Studio will normally restore the materially lost access by extending the Pass expiry time. If extension is not technically practical, MC Studio may provide an equivalent replacement entitlement. This does not limit mandatory statutory remedies.
The project binding and expiry of a Production Pass are controlled by MC Studio's server-side entitlement records. Purchase and immediate-performance acknowledgement records are retained as described in the Refund & Withdrawal Policy and Privacy Policy.
7. Prices, VAT and payment
Prices, applicable taxes, billing frequency, contract duration and material renewal conditions are shown before purchase.
Consumer-facing prices are shown inclusive of applicable VAT and unavoidable charges where required. Business prices may be shown exclusive of VAT where lawful and clearly indicated.
Payments are processed through Stripe. MC Studio generally does not receive full payment-card details.
For a Consumer electronic checkout that creates an obligation to pay, the final order control is clearly labelled Pay now, Buy now or an equivalent phrase indicating the payment obligation. The material characteristics, total price, duration and withdrawal information required by law are shown clearly and prominently directly before the order is placed.
By activating the payment control, you authorise MC Studio and its payment provider to charge the price and applicable taxes according to the selected billing cycle.
MC Studio may retain billing and entitlement evidence reasonably necessary to administer the agreement and prove the purchase flow, including payment/transaction identifiers, successful-payment timestamps, plan/entitlement, entitlement start/end, Terms version and cancellation state. For a Consumer Production Pass, MC Studio also retains the account/user identifier, Pass/entitlement identifier, workshop/workspace identifier, exact project ID, entitlement status, accepted immediate-performance wording/version and the timestamps of the required acknowledgements.
8. Monthly and annual subscriptions
A monthly subscription renews monthly until cancelled. Cancelling future renewal normally leaves access active until the end of the already-paid period.
An annual Business subscription is a fixed 12-month commitment unless the Order says otherwise. Voluntary non-use or early cancellation does not create a pro-rata refund for unused months. If the Order provides for automatic renewal, cancellation stops the next renewal in accordance with the Order.
An annual Consumer subscription is subject to mandatory consumer law. The initial fixed term may run for 12 months where permitted. If it renews automatically, any mandatory cancellation rights applicable to the renewed period remain unaffected. For Dutch Consumers, where the statutory automatic-renewal rules apply, cancellation after renewal must be possible at any time with no more than one month's notice and through the routes required by law, with repayment of unused prepaid value where mandatory law requires it.
The Cancellation & Subscription Policy forms part of these Terms.
9. Failed payments
If a recurring renewal payment fails, MC Studio may retry collection and notify the customer. The paid entitlement remains active during a 7-calendar-day payment-recovery period beginning with the failed renewal.
If payment is recovered during that period, the subscription continues without an ordinary payment-failure downgrade.
If payment remains unsuccessful when the seven-day recovery period ends:
-
the paid entitlement ends;
-
the account/workspace remains open; and
-
the workspace automatically falls back to the applicable Free entitlements.
Ordinary payment failure does not cause immediate deletion of customer data and is not automatically treated as misconduct or fraud. MC Studio may separately restrict or suspend an account where there is evidence of fraud, deliberate payment or entitlement circumvention, security risk or another serious breach.
10. Upgrades, downgrades and data continuity
Upgrades may take effect immediately after successful payment and any clearly disclosed proration.
Voluntary downgrades normally take effect at the end of the already-paid period unless the Order or mandatory law requires otherwise.
MC Studio's principle is that a downgrade removes paid capability rather than destroying customer data.
Under the current Free model, a workspace may have up to 8 active/editable projects, and each active project may retain its normal editable design. If a paid workspace falls back to Free with more than eight stored projects, MC Studio will keep the 8 most recently modified projects and their designs active/editable. Older paid-created projects and designs remain preserved but become locked/read-only rather than being deleted solely to enforce the Free active-project limit.
The most-recently-modified rule is applied automatically; MC Studio does not promise a user-selection step for downgrade. Current plan limits shown at purchase control if the commercial package later changes.
Locked/read-only history remains subject to the retention, deletion, export and processor obligations in these Terms, the Privacy Policy, the DPA and applicable law.
11. Cancellation, account closure and retention
Cancelling a subscription is different from deleting an account.
After cancellation or downgrade, MC Studio may retain archived or locked workspace data for up to 12 months as a recovery window, subject to:
-
a valid earlier deletion or erasure request;
-
MC Studio's obligations when acting as processor for Business Customer data;
-
legal, security, fraud-prevention and record-keeping obligations; and
-
the separate account-deletion lifecycle below.
A normal account-deletion request enters a 30-day recovery period intended to protect against accidental deletion. Unless a lawful reason requires retention, primary customer/workspace data is permanently deleted after that recovery period and ordinary backup copies are deleted or expire within the same 30-day deletion lifecycle.
A valid GDPR erasure request or valid Controller deletion instruction may require MC Studio to permanently delete relevant data before the 30-day accidental-deletion recovery period ends. MC Studio will not use the recovery period as a blanket reason to delay a statutory erasure right.
Accounting, tax, transaction, security or legal records may be retained for the period required or permitted by law even after account/workspace deletion. Such retained records are segregated from ordinary product use where appropriate.
12. Data export and switching
MC Studio currently provides exports through a manual, administrator-assisted process. Customers may request export or switching assistance through privacy@mcstudio.io or info@mcstudio.io.
The MC Studio Data Portability & Switching Policy forms part of these Terms where applicable. It explains the current request route, applicable switching rights, transition/retrieval principles and EU Data Act requirements.
MC Studio will provide data in structured, commonly used and machine-readable formats and original uploaded files where applicable and legally required. Current data categories, structures, formats and known limitations are described on our Data Export & Portability page. That information does not restrict mandatory access, return, deletion or switching rights.
Where the EU Data Act applies to MC Studio as a provider of a data processing service, MC Studio will not impose contractual, commercial, technical or organisational obstacles prohibited by that Regulation and MC Studio's current policy is not to charge a special switching fee.
GDPR access and portability rights remain separate and are not reduced by the Data Portability & Switching Policy.
13. Customer Content and ownership
As between MC Studio and the customer, the customer retains ownership of Customer Content and original designs, subject to third-party rights.
MC Studio receives only the rights reasonably necessary to host, process, copy, transmit, render, back up and otherwise use Customer Content to provide, secure, support and maintain the Services and to comply with law.
MC Studio does not claim ownership of a customer's furniture design merely because it was created in MC Studio.
Lawfully generated and exported project outputs may be used by the customer, including for commercial manufacturing, subject to third-party rights and any specific licence attached to third-party or MC Studio library components.
14. MC Studio Materials and licences
MC Studio and its licensors retain all rights in the software, interfaces, documentation, brand, libraries and other MC Studio Materials.
During the applicable entitlement period, MC Studio grants the customer a limited, non-exclusive, non-transferable right to use the Services for the purposes permitted by the relevant plan and these Terms.
Where an MC Studio library element is embedded in a legitimate customer project output, the customer receives the rights reasonably necessary to use that embedded element as part of the resulting project and manufactured work, unless a specific asset licence says otherwise.
15. Marketplace and published content
Private Customer Content is not marketplace content.
If MC Studio later allows users to publish, sell or distribute designs, templates, components or other content through an MC Studio Marketplace, additional Marketplace Terms presented at publication or listing will govern the necessary hosting, distribution, sale, buyer-licensing, commission, verification and takedown rights.
Publishing content to a marketplace does not automatically transfer ownership to MC Studio. The creator must grant the distribution and related rights stated in the applicable Marketplace Terms.
16. Feedback
If you voluntarily provide suggestions, ideas or product feedback, MC Studio may use that feedback without an obligation to implement it and without royalty or compensation.
Feedback does not transfer ownership of your Customer Content, designs or other intellectual property to MC Studio.
17. AI-enabled features
MC Studio does not currently use a customer-facing AI provider in the Service. Customer Content is not sent to Anthropic, OpenAI or another AI provider as part of a current customer-facing AI feature.
MC Studio may use materials that MC Studio owns or is authorised to use to develop its software and internal product capabilities.
MC Studio will not use private Customer Content, private CRM records, private customer designs or uploaded files to train general-purpose AI models by default.
If MC Studio later introduces a customer-facing AI feature, the applicable product notice and Privacy Policy will identify the feature and relevant provider/data flow before customer data is processed where required. MC Studio will establish the necessary legal basis, contractual safeguards and transparency before such use goes live.
Where future AI functionality is subject to transparency or other requirements under the EU AI Act or other applicable law, MC Studio will implement the applicable requirement for that feature.
18. Verified Assets and customer-created technical content
A Verified Asset is verified only for the conditions stated in its verification record, which may include software version, dimensions, hardware, materials, machine/controller, post-processor, tooling assumptions, known limitations and last-verification date.
For Business Customers, MC Studio warrants that an unmodified Verified Asset will materially conform to its published verification record when used under the stated supported conditions.
If a Verified Asset does not conform to that warranty, the first remedy is normally for MC Studio to correct, replace or withdraw the affected Verified Asset within a reasonable time where this is possible. Any proven residual loss is governed by the applicable liability provisions and mandatory law.
The customer remains responsible for project-specific inputs and circumstances, including:
-
site and furniture measurements;
-
selecting materials/hardware outside stated assumptions;
-
machine condition, calibration and safe operation;
-
tooling and workholding;
-
modifications to Verified Assets;
-
custom or unverified machining operations;
-
following warnings and documented limitations; and
-
final project review before cutting, machining, installation or other irreversible work.
The customer's review obligation does not transfer responsibility for a hidden defect in an unmodified Verified Asset back to the customer where the asset failed its stated verification conditions.
A customer-created or modified asset is not Verified merely because it originated from a Verified Asset. Mandatory consumer conformity rights and liability that cannot lawfully be limited remain unaffected.
19. Acceptable use
You must not:
-
use the Services unlawfully or to infringe another person's rights;
-
upload malware or attempt to compromise MC Studio systems;
-
bypass payment, entitlement, seat, access or security controls;
-
share named-user credentials as a substitute for purchasing required seats;
-
use automated methods that materially overload or disrupt the Services;
-
reverse engineer the Services except to the extent mandatory law expressly permits;
-
falsely represent an unverified output as MC Studio Verified;
-
use the Services in violation of applicable sanctions or export-control laws.
MC Studio may investigate suspected abuse and take proportionate action.
20. Illegal content, hosting and content restrictions
To the extent MC Studio stores information at a user's request and qualifies as a hosting or intermediary service under the EU Digital Services Act, the following rules apply.
Anyone may use MC Studio's Illegal Content Notice mechanism to notify MC Studio of specific information they consider illegal. The mechanism and required information are described in the Illegal Content Notice & Action Policy.
MC Studio will process sufficiently precise notices in a timely, diligent, objective and non-arbitrary manner. Where electronic contact details are available, MC Studio will acknowledge the notice and inform the notifier of its decision and available redress.
If MC Studio removes content, disables access, restricts payments, suspends a Service or suspends/terminates an account because content is allegedly illegal or violates these Terms, MC Studio will provide the affected user with a clear statement of reasons where the Digital Services Act requires one.
Restrictions are applied proportionately and with due regard to the rights and legitimate interests of affected users. MC Studio may act urgently where there is a credible threat to life, safety, security, law-enforcement obligations or another serious legal risk.
21. Suspension and termination by MC Studio
MC Studio may immediately restrict or suspend access where reasonably necessary to address:
-
a serious security incident or compromised account;
-
fraud or deliberate entitlement/payment circumvention;
-
unlawful use;
-
malware, attacks or material system abuse;
-
serious infringement of third-party rights;
-
a legal or regulatory requirement;
-
conduct creating an urgent and material risk to MC Studio, other users or systems.
For ordinary remediable breaches, MC Studio will normally provide notice and a reasonable opportunity to cure before termination.
Non-payment is normally handled through the billing and downgrade process rather than disciplinary suspension.
Where appropriate, MC Studio will preserve a reasonable data-export route, except where doing so would create a security, legal or fraud risk.
22. Service changes and discontinuation
MC Studio may update the Services where reasonably necessary for security, legal compliance, compatibility, interoperability, technical dependencies, abuse prevention, product improvement or continued operation.
For a Consumer Service supplied over a period of time, a modification going beyond what is necessary to maintain conformity will be made only where the agreement permits the change for a valid reason, without additional cost to the Consumer, and with clear information about the change.
If such a modification negatively affects a Consumer's access to or use of the digital Service beyond a minor degree, MC Studio will provide reasonable advance notice on a durable medium stating the features and timing of the change and the Consumer's applicable right to terminate free of charge within the statutory period, unless MC Studio enables the Consumer to retain the unchanged conforming Service without additional cost.
If MC Studio retires a material paid plan or the Service as a whole, MC Studio will give at least 30 days' advance notice where reasonably possible, together with a reasonable export route. Emergency legal or security action may require shorter notice.
If MC Studio ends a prepaid paid Service before the paid term ends without customer fault, MC Studio will provide an appropriate continuation/replacement option or refund the unused prepaid portion where required by the agreement or applicable law.
23. Support
MC Studio provides self-service guides, tutorials and support channels.
Professional plans may include guided onboarding, first-project review and reasonable support for supported workflows, as stated in the plan or Order.
Unless an Order expressly states otherwise, MC Studio does not promise:
-
24/7 support;
-
a guaranteed response or resolution time;
-
a one-hour SLA;
-
a dedicated account manager;
-
unlimited training, consulting or migration;
-
unlimited custom machine or post-processor engineering.
Nothing in this section limits statutory rights concerning a defective digital service.
24. Security
Customers must use reasonable security practices, including strong passwords and restricting access to authorised users.
MC Studio will maintain organisational and technical measures appropriate to the nature and risk of the Services. No online service can be guaranteed to be completely secure.
Security incidents involving personal data are handled in accordance with applicable data-protection law and the DPA where applicable.
25. Privacy and data protection
The Privacy Policy explains how MC Studio processes personal data when acting as controller.
Where a Business Customer uses MC Studio to process personal data on behalf of that Business Customer, the MC Studio Data Processing Agreement applies where required.
The customer is responsible for having a lawful basis and providing required notices for personal data the customer puts into MC Studio.
26. Third-party services
MC Studio currently relies on third-party infrastructure and service providers including:
-
Supabase for PostgreSQL database services, authentication and file storage;
-
Vercel for hosting/application delivery;
-
Stripe for payment processing; and
-
Resend for transactional email sent from addresses such as notifications@mcstudio.io.
The Supabase production project is configured in an EU region. This does not mean that every provider or every support, delivery or administrative operation processes data only in the EU. MC Studio does not currently use a separate third-party analytics provider or separate error-monitoring provider in its core application stack.
Information about provider roles, relevant processing locations and international-transfer safeguards is available in the Privacy Policy, the DPA and our Subprocessors page. Subprocessor additions and replacements are subject to the notice and authorisation process in the DPA where applicable.
Third-party services may be subject to their own terms and privacy rules. MC Studio is not responsible for a third party's independent acts outside MC Studio's reasonable control, but this does not exclude responsibility that applicable law places on MC Studio for its selection or use of processors/subprocessors.
27. Business Customer warranties and indemnity
A Business Customer warrants that it has the rights and lawful basis necessary for Customer Content it submits and for instructions it gives MC Studio.
To the extent permitted by law, a Business Customer will indemnify MC Studio against third-party claims arising directly from the Business Customer's unlawful Customer Content, infringement of third-party intellectual-property rights, or material misuse of the Services, except to the extent caused by MC Studio.
This section does not apply to Consumers.
28. Business Customer limitation of liability
This section applies only to Business Customers.
Subject to liability that cannot legally be limited, MC Studio's total aggregate contractual and non-contractual liability to a Business Customer arising out of or relating to the affected paid Service will not exceed the greater of:
-
100% of the fees actually paid by that Business Customer for the affected Service during the 12 months immediately preceding the event giving rise to the claim; or
-
EUR 500.
The cap is a maximum, not a guaranteed payment. A customer may recover only loss that is legally recoverable, sufficiently caused by the breach and actually proven.
To the maximum extent permitted by law, MC Studio is not liable to a Business Customer for indirect or consequential loss, lost profit, lost revenue, lost anticipated savings, lost goodwill or lost business opportunity.
Nothing in these Terms excludes or limits liability to the extent exclusion or limitation is prohibited by mandatory law, including liability for fraud or intentional misconduct and applicable liability for death or personal injury.
29. Consumer rights and conformity
Nothing in these Terms excludes or limits a Consumer's mandatory statutory rights.
Where consumer law requires a digital Service to conform to the agreement, MC Studio remains responsible for the remedies required by law. Depending on the circumstances, these may include supplying the Service, bringing it into conformity, supplying required updates and security updates, price reduction, termination and/or refund.
Consumer conformity is assessed by the agreed features as well as the qualities and performance a Consumer may reasonably expect, taking into account applicable law, technical standards, the nature of the Service and relevant public statements that formed part of the Consumer's decision.
Any disclaimer, Beta label, liability clause, plan limit or other contractual term must be read subject to mandatory consumer law.
30. Force majeure
MC Studio is not responsible for delay or failure caused by events beyond its reasonable control, such as major internet outages, utility failures, natural disasters, war, government action or widespread third-party infrastructure failure, to the extent permitted by law.
MC Studio will use reasonable efforts to mitigate material effects.
31. Price changes
MC Studio may change future subscription prices for valid commercial reasons.
MC Studio's standard policy is to provide at least 30 days' advance written notice of a price increase.
A price increase will not change the price of an already-paid fixed term. The new price applies at a future renewal unless the applicable Order or protected promotional term says otherwise.
Customers may cancel before the renewal at the new price. Mandatory consumer rights remain unaffected.
32. Promotions and Founding Collaborators
Promotions are subject to the Promotion Terms and any campaign-specific terms.
The private Founding Collaborator programme is subject to the Founding Collaborator Addendum and does not create a lifetime price unless an individual written agreement expressly says so.
Promotional discounts do not stack unless MC Studio expressly confirms otherwise in writing.
33. Language and versions
The contractual language is the language in which the relevant terms are presented and accepted in your purchase or contracting journey. Where another language version is supplied, the rules below govern any discrepancy.
For a Business Customer, the English version prevails over a translation only where the Order says so and applicable law permits.
For a Consumer, MC Studio will not rely on an English-language discrepancy to reduce mandatory rights or to contradict the version of the contractual information actually presented and accepted in the Consumer's purchase journey. Mandatory interpretation rules always prevail.
34. Governing law
These Terms and any contractual or non-contractual obligations arising out of or relating to them are governed by the laws of the Netherlands.
If you are a Consumer, this choice of law does not deprive you of protection afforded by mandatory provisions of the law that would apply in the absence of this choice, including where applicable the law of your country of habitual residence.
35. Disputes and jurisdiction
Please first contact legal@mcstudio.io (or info@mcstudio.io) so that MC Studio can try to resolve the issue.
For Business Customers, to the extent permitted by law, disputes will be submitted exclusively to the competent court in the Netherlands in the district where MC Studio is established.
Consumers retain the right to bring proceedings before any court available to them under mandatory applicable law.
The former EU Online Dispute Resolution platform has been discontinued and is not relied on by these Terms.
36. Notices
MC Studio may send contractual notices to the email address linked to your account or through a prominent in-product notice where appropriate. Where these Terms, the DPA or applicable law require direct notice or a durable medium, MC Studio will use a method meeting that requirement. A blog post or an unannounced change to a webpage is not a substitute for such notice.
You are responsible for keeping your contact information current.
37. Changes to these Terms
MC Studio may update these Terms for a valid legal, security, technical or commercial reason.
A change does not retroactively remove accrued rights or alter an already-paid fixed term unless mandatory law or an individually accepted amendment permits it.
For existing Consumers receiving a digital Service over time, changes that modify the Service or contractual position are subject to the mandatory digital-service modification rules described in these Terms. Material changes will be notified in advance on a durable medium where required.
If applicable law requires renewed consent or acceptance, MC Studio will obtain it before relying on the change.
38. Assignment
A Business Customer may not assign its agreement without MC Studio's written consent, except as part of a bona fide business reorganisation or sale where reasonable notice is provided and the assignee can comply with the agreement.
MC Studio may transfer the agreement as part of a merger, acquisition, restructuring or sale of the business, subject to applicable law and continued protection of customer rights.
Consumer rights are unaffected.
39. Severability and waiver
If part of these Terms is unenforceable, the remaining provisions continue to apply to the extent legally possible.
A failure to enforce a provision once does not waive the right to enforce it later.
40. Entire agreement and order of precedence
The agreement may include these Terms, the applicable Order/checkout, plan description, Refund & Withdrawal Policy, Cancellation & Subscription Policy, Privacy Policy, Cookie Policy, Data Processing Agreement where applicable, Data Portability & Switching Policy, Legal & Export Restrictions, Illegal Content Notice & Action Policy, Promotion Terms and any signed addendum.
The most important product, price, duration, renewal and consumer information is shown directly in the Order/checkout and must not be hidden solely in general Terms.
If contractual documents conflict, the following order applies unless mandatory law requires otherwise:

a customer-specific signed Order or addendum;

the applicable plan/checkout terms and any feature-specific terms;

these Terms;
-
other referenced general policies/schedules.
The DPA takes priority for the processing of Customer Personal Data on behalf of a Controller, as stated in that DPA. The Founding Collaborator Addendum takes priority for the Founding-specific matters it expressly governs. No Order, addendum or other document overrides mandatory law.
Privacy and cookie notices explain data processing and do not by themselves create a waiver of legal rights. Accepting these Terms is not, by itself, consent to optional cookies, marketing or unrelated processing of personal data.
Product capability remains subject to the Supported/Beta/Experimental status disclosed at purchase and in current release documentation.
